Imho the problem with the judgement is there really should have been a special separate system for long running stuff set up. It was such a concern that they spent a bunch of money to temporarily move away from Mickey Mouse before the judgement. They were worried about knockoff Mickey Mouse stuff appearing everywhere. One of the more famous ones was done in the 50’s and is a scene of Minnie and Mickey having sex. The argument Disney was making for their stuff revolved around the time honored practice of animators making short films in the margins of major films visible only to the projectionists. But suffice it to say, it's a lot harder to create content that is worth paying for if you are competing against content in the public domain which is why companies like Disney try very hard to not let their content into the public domain, while still trying to pillage the public domain for their own use. So you can not even predict where technology will be. Yeah, however all of earths knowledge, and media has been recorded in a digital way in only the last 40 years. And those groups are generally perfectly happy with falsehood as long as it serves their purpose. The problem with that though is that kind of content is almost always only an advertisement of some kind, be it for a product or political faction or religious group. For some that payment is in distribution. If they don’t get paid they don’t create. The 580 year old problem remains the same though. You make it, everyone who wants it will have it within seconds of you making it available, with no middle-men. What will ultimately happen, maybe not this century, is that copyright will stop mattering, as every piece of content will be available without the artificial scarcity. Now any piece of data can be copied and duplicated a billion times in seconds, and copyright law was just not designed around that. Other countries that have moved slower on copyright reform recognize all the problems with the DMCA and have not enacted policies that behave the same.Ĭopyright, law itself, reflects a time when the printing press was starting to be a thing, and books were hand-written. Short term profits over long term sustainability. Nothing is likely to happen, ever, because that's just how US culture is. OR the supreme court need to strike it down, which is wont because copy rights are a protected right under the US constitution. The only way to fix the BS is for Congress to fix the BS. Until Congress fixes the law, stuff like this will happen. ![]() The problem is "Fair use" is not well defined by the law. It doesn't matter what the law originally applied to, the courts will decide what its applies to. Its a 20th century law in a 21st century world.
